Important Notice About Text Messaging Data
ReShapesRx & Wellness does not share text messaging opt-in information — including your mobile number and the record of your consent — with any affiliate or third party for marketing or promotional purposes. Opt-in data is treated as confidential and is used only to deliver the messages you asked to receive.
1. Who We Are and What This Policy Covers
ReShapesRx & Wellness ("ReShapesRx," "we," "us," or "our") operates a medical aesthetics and wellness practice located at 3211 Cummings Highway, Chattanooga, TN 37419, along with the website at www.reshapesx.com (the "Site").
This Privacy Policy explains how we handle information collected through our website, our online forms, our email and text message programs, our social media channels, and our general business operations.
This policy is separate from our Notice of Privacy Practices. Protected health information created or maintained in the course of your care — your chart, your treatment records, your clinical photographs, your medical history — is governed by the Health Insurance Portability and Accountability Act (HIPAA) and by our Notice of Privacy Practices, which is provided to you at your first visit and is available on request. Where the two documents overlap, the Notice of Privacy Practices controls with respect to protected health information.

Reviews, testimonials, survey responses, and other feedback you choose to share

To schedule, confirm, remind, and follow up on appointments

4. Text Message (SMS) Program
We operate two separate text message programs, and consent to one does not enroll you in the other.
Transactional messages
These include appointment confirmations, appointment reminders, scheduling changes, post-treatment care instructions, form or document requests, and replies to questions you send us. These messages support your care and your scheduled visits.
Promotional messages
These include offers, events, product launches, membership announcements, and other marketing content. Promotional text messages are sent only to people who have separately and affirmatively agreed to receive them.
Consent
You are enrolled only if you check the applicable consent box on one of our forms, submit a written request to be added, or provide consent in person or in writing at our practice
Consent to receive text messages is never a condition of purchasing any product or service or of receiving care
We keep a timestamped record of each consent, including the form or capture point where it was given
You must be 18 years of age or older to enroll in our text message programs
Opting out
You may stop receiving text messages at any time by replying STOP to any message from us. We will send one confirmation message and then stop sending. If you have consented to both transactional and promotional messages and want to stop only one of them, reply to any message or contact us at reshapesrxandwellness@gmail.com and tell us which you would like to end. To rejoin, opt in again through any of our forms or contact the practice directly.

Mobile data sharing statement
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
5. How We Share Information
We do not sell, rent, or trade your personal information. We share information only in the following circumstances.
Service providers
We use vendors to run the practice — including our practice management system, customer relationship management and marketing platform, payment processors, text message providers and aggregators, email delivery services, website hosting, and analytics providers. These vendors receive only the information they need to perform their function and are contractually required to protect it. Where a vendor handles protected health information, we maintain a Business Associate Agreement as required by HIPAA.
Legal and safety
We may disclose information where required by law, subpoena, court order, or valid governmental request; to establish or defend legal claims; to enforce our terms; or to protect the rights, property, or safety of our patients, our staff, or the public.
Business transfers
If the practice is involved in a merger, acquisition, financing, or sale of assets, patient and customer information may transfer as part of that transaction. Your information would remain subject to a privacy policy consistent with this one.
Each of the above categories excludes text messaging opt-in data and consent records, which are not shared with any third party other than the providers and aggregators that deliver the messages themselves.
6. Cookies, Analytics, and Advertising Technologies
Our website uses cookies, pixels, and similar technologies to remember your preferences, understand how the site is used, measure the performance of our campaigns, and, where enabled, deliver advertising on third-party platforms. You can control cookies through your browser settings, and most browsers allow you to refuse or delete them. Disabling cookies may affect how parts of our site function.
We do not use advertising or analytics pixels in a way that transmits protected health information to third-party advertising platforms.

Please note that even if you opt out of marketing, we will still send transactional messages related to your appointments and care unless you ask us to stop those as well.
9. Children and Minors
Our website and our text message programs are intended for adults 18 and older, and we do not knowingly collect personal information online from children under 13. Certain services may be provided to minors in the practice with the consent and participation of a parent or legal guardian, subject to Tennessee law and our clinical policies. If you believe a child has provided us information online, contact us and we will remove it.
10. Photographs, Reviews, and Social Media
We photograph treatment results only with your separate written authorization, and that authorization specifies how the images may be used. You may revoke authorization for future use at any time by contacting the practice in writing, though we cannot recall material already published or shared. If you tag us, comment on our posts, or submit a review, that content is public and governed by the policies of the platform where it appears.
11. Data Retention and Third-Party Links
We keep personal information for as long as needed to provide services, meet legal and professional record-retention requirements, resolve disputes, and enforce our agreements. Medical records are retained for the period required under Tennessee law. Marketing consent and opt-out records are retained as required for compliance purposes.
Our site may link to third-party websites. We are not responsible for their content or privacy practices, and we encourage you to read their policies before providing information.
12. Changes and Contact
We may update this Privacy Policy from time to time. The current version will always be posted on our website with its effective date. If we make a material change, we will provide notice by email or through a notice on the site.
